Records Review

MD or RN Medical Records Review?

We just had a recent case involving a RSI (Retained Surgical Instrument). The attorney hired an outstanding Neurosurgeon Testifying Expert, who read the medical records, received a nice retainer for the review and then proclaimed to the attorney that you need a Neuro Surgical RN to look at these records! A physician cannot testify to the Nursing Standards of Care; nor can a RN testify to the Medical Standards of Care. However, as in the RSI case above, if the attorney had started with a qualified nurse review of the records,  he would have saved a lot of time and money!

Who is the patient’s advocate in a case? Who examined & reported on your client – THE PATIENT – every day. That was a RN. No one is closer to a patient/client medical record than a nurse.

Obviously, there is a time when a MD is needed to consult on their particular expertise.

If a medical record can be thought of in terms of A to Z, who is there at the beginning, the middle and the end. It is the Nurse, not the MD.

Why use a CLNC to review records?

You understand the courthouse; we understand the medical records.

As the provider with the most day-to-day patient contact, a CLNC can offer medical & nursing opinions as an expert on health, illness, injury and the inner workings of the healthcare system. We will answer questions, research topics, analyze records or locate other experts to help in the records review process.

Our firm provides expert navigation through both electronic and written records for medical records review.

Our combined decades of clinical, “bedside” nursing, provides a reality to our consulting practice that can’t be gained from reading theory in a textbook. Our experience in nursing administration allows us to see the total picture, including issues such as staffing, accreditation, policy and procedures, as well as the inner workings of a hospital from the ground up.

And as clinicians, we understand how to evaluate the validity and reliability of medical research. Our unique experience can save you time & money as well as providing quick turnaround on the critical review process. We can weed out the irrelevant issues and get to the heart of the matter quickly, assuring you don’t miss a relevant fact, issue or supporting research.

Keep your focus and your team’s focus on the legal issues and don’t waste valuable resources of your firm. Regardless of your specialty, we can help your profits grow and give you the time to take on more of the cases you feel passionate about!

How many EMRs are there?

There are 10 major systems that make up 90% of the market for hospital electronic medical records systems:  Meditech, Cerner, Epic, McKesson, Siemens, CPSI, Heathland, Healthcare Management Systems, Allscripts and NextGen Healtcare.  The remaining market share is self-developed systems or small, niche vendors.

Does an MD know all these systems?
Does an off shore reviewer know all these systems?

Domestic review vs Off Shore review

Each Associate of McDonald & Associates Legal Nurse Consultants is a domestically trained Registered Nurse and Certified Legal Nurse Consultant. We know how the US Healthcare system works. We have invested our lives in it and many of us still maintain our clinical practices.

It is tempting to try an off shore review service. Many of our clients have tried it once.

It is cheaper, but, as we all know, in the end…we get what we pay for.

Think of this, besides the obvious language and cultural differences, do you have confidence that the person allegedly doing the medical record review is qualified to do so?

If you had follow-up questions concerning the review, who do you speak to?  Are you discussing the case with the same person who performed the review?  Is the consulting expert who performed the review available 24/7 as we are?

And more importantly, what about HIPPA compliance ? Are the legal documents and medical records safe, secure or private if you choose a reviewer overseas?
